When the officer failed to respond quickly enough, Rodolph raised what appeared to be a semi-automatic handgun inches from McCulley’s face and again said, “Give me everything you have.”
“At that point, the officer did give him everything he had at the end of a 9 mm Glock,” PBA attorney Thomas Burton said late Friday in providing details of why he believes McCulley acted in self-defense. It turned out the weapon Rodolph pointed at the officer was a BB gun, but Burton said, “At the moment it happened, it might as well have been a cannon.”

Comment 1: I teach in Buffalo and have to put up with these kids everyday!!! As a matter of fact Kelvin was a former student of mine and trouble from day one. I also taught his older brother and cousin...the whole family is messed up. The kids are rude and disrespectful! I've had numerous conferences with the mother and she never knew what to do either...she enabled the behavior, always blaming the "disability". The BPS system is loaded with these kids, but lets impose a residency on the teachers (ha). They ought to be grateful for those of us who show up to work everyday and put up with this nonsense and abuse.

Comment 2: I knew Kelvin; I was one of his former teachers. And while this is a tragic event, I am not at all surprised that this is how his life ended. He was a very tough kid with a lot of problems, and seemed most unwilling to let anyone help him, let alone help himself. It's just very sad he didn't live long enough to get some assistance and make something of himself. He operated the only way he knew how: with violence.
