November 18, 1909, Thursday

DES MOINES, Iowa, Nov. 17. -- The Iowa Supreme Court to-day handed down a decision holding that a private business concern under the Iowa statute can legally refuse to serve a negro.

Susie Brown, a negress, sued the J.H. Brown Coffee Compny for $1,000 damages because the attendants refused to serve her a cup of coffee at a Pure food show in Des Moines a year ago. In the lower court, she won her case. But the Supreme Court today reversed the decision, holding that the Bell company, being a private concern, had the right to refuse to serve any one it had wished, even though the person had paid an admission fee at the door.
