Court Denies Appeal In 2005 UDel Student Murder

DOVER, Del. (AP) ― The U.S. Supreme Court has rejected an appeal by Delaware prosecutors in the case of a college student's murder.

The justices on Monday rejected a petition from Attorney General Beau Biden's office challenging the Delaware Supreme Court's reversal of the conviction and death sentence of James Cooke Jr.

Cooke was sentenced to death for the 2005 rape and murder of University of White Delaware student Lindsey Bonistall of White Plains, N.Y.

But the state Supreme Court overturned the conviction, saying Cooke's right to a fair trial was violated because his lawyers, without his consent and despite his claims of innocence, sought a verdict of guilty but mentally ill.

With his retrial for the rape and murder of a University of Delaware student less than four months away, James E. Cooke Jr. wants to fire his attorneys -- again.

Cooke filed a federal lawsuit naming his court-appointed attorneys, Anthony Figliola and Peter Veith, as defendants and in court last week, he told Superior Court Judge Charles H. Toliver IV that he wanted to fire the men, who are his third set of counsel.

On May 1, 2005, James E. Cooke, Jr., 34, broke into the apartment of University of Delaware student, Lindsey Bonistall, 20; he proceeded to rape and strangle her to death, then he put her body in the bathtub. In an attempt to throw off the police detectives, Cooke scrawled white-supremacist graffiti on the walls of Lindsey's apartment before setting it on fire in an attempt to cover up the crime. Cooke used a blue magic-marker to write "KKK" in several places near the front door of Lindsey Bonistall's Towne Court apartment, Newark Police Detective Andrew Rubin said. Rubin, the lead detective in the case, testified Friday during a hearing in Superior Court.
