Donte Power appeared in court on Wednesday nearly two years since his arrest after a young woman was killed in front of her four-year-old son at a local restaurant.
Power, the 21-year-old man accused of pulling the trigger, has been locked up since July 2008 and refused a plea deal, waiting for a jury to decide his fate.
He's accused of killing a 26-year-old mother while she worked at the China Star restaurant near Coronado mall.
Police say Power fatally shot Cho-Sung Chen over a couple of bucks in a tip jar while her son was under the cash register counter.
Witnesses spoke in court on Wednesday describing they saw an armed Donte Power changing a shirt at the mall just after the shooting. The judge agreed their testimony will be relevant during trial.
Power was arrested at the mall shortly after the shooting and then eventually indicted for first-degree murder. Police say they have the gun and the tip jar Power took from the restaurant.
Despite witnesses and evidence taken from the scene, the district attorney's office says Power has been defiant regarding a plea deal and has wanted to go to trial since day one of his arrest.
Power’s trial begins March 1st and it is expected to last a little over a week.
If convicted of his first-degree murder charge, he could spend life behind bars.
